Consumer Dispute Resolution within the European Union

In accordance with applicable European Union consumer protection legislation, consumers residing within the European Economic Area may have access to alternative dispute resolution mechanisms for disputes arising from online purchases made through the Delariva Store website.

The European Commission provides an official Online Dispute Resolution platform (“ODR Platform”) designed to facilitate the out-of-court resolution of disputes between consumers and online traders.

Purpose of the ODR Platform

The platform was created by the European Commission to provide consumers with a transparent, accessible and non-judicial method for resolving disputes related to:

  • online purchases;
  • digital services;
  • e-commerce transactions;
  • cross-border consumer disputes within the European Union.

Consumers may use the platform to submit complaints relating to products or services purchased online from traders established within the European Union.

Alternative Consumer Dispute Resolution

Consumers may also have the right to resort to recognised Alternative Dispute Resolution (“ADR”) entities operating within their country of residence, subject to applicable national legislation.

The use of ADR or ODR mechanisms does not affect the consumer’s statutory rights under applicable consumer protection laws.


Applicable Legislation

This notice is provided in accordance with, among others:

  • Regulation (EU) No 524/2013 on Online Dispute Resolution for consumer disputes;
  • Directive 2013/11/EU on Alternative Dispute Resolution for consumer disputes;
  • applicable Portuguese and European consumer protection legislation.

Jurisdiction and Applicable Law

Without prejudice to mandatory consumer rights established under applicable law, any contractual relationship established through Delariva Store shall be governed by Portuguese law.

Where legally permissible, disputes may be submitted to the competent courts of Portugal.
